
The College of Law at Al-Nahrain University discusses the master’s thesis entitled Automatic Cassation and Its Impact on Criminal Judgment, submitted by Furqan Waleed Fadhil, a student in the Department of Public Law.
The significance of the study lies in clarifying the legal nature of automatic cassation and defining the limits within which the court exercises its automatic authority. It also analyzes the effects resulting from the application of this system on criminal judgments in terms of legal authority, enforceability, and stability, as well as the possibility of benefiting from its outcomes in developing criminal procedural legislation in a manner that achieves a balance between the principle of the stability of judgments and the necessity of correcting serious judicial errors.
The study aimes to determine whether the system of automatic cassation constitutes a method of appeal or an independent supervisory mechanism, in addition to analyzing its impact on criminal judgments, particularly in addressing judicial errors.
